Was watching the news at 6pm, they interviewed Rob concerning a bus fire. He was on the bus headed to Chicago.

Well, shit.  You people watch TV.

Yes, we're OK.  There was a good 3-4 minutes between the time we saw smoke coming up the side of the bus and the time we had evac'd.  Pulling idiots who stopped 10 feet away from the bus to take cell phone video was an entirely different issue.  It's not like they were in serious danger (gas takes a very specific fuel/air ratio to explode, and a fire next to a full gas tank isn't even close to it), but it's the principle of the thing.

We lost about $1500 worth of clothes and luggage, plus $500 worth of fighting cloaks and a nerf prop gun I had just finished, but fortunately weren't transporting any swords or real high-ticket items.  Now we're just waiting to see if Megabus is going to be sane, or force us to follow the policy for damaged/destroyed luggage as listed on their website:

Summary: Maximum $250 reimbursment for any and all reasons (see list of exclusions), to file a claim you must file for a 3rd-party arbitration (arbitrator chosen by Megabus LLC).  Filing must be done in person in <law office> in the state of New York, and you will be charged a $400 filing fee.  (http://us.megabus.com/terms.aspx)

Small claims doesn't apply.  By the act of purchasing a ticket, you agree that any and all dispute between yourself and Megabus is to be handled by an arbitrator.  it's a lot like releasing a hockey team from damages caused by flying pucks.

Now, in practice and in a real court, that shit doesn't fly.  Seriously, it's unenforceable, and we absolutely can sue, and probably even win.  You cannot simply recuse yourself from all liability and force a person to give up their right to sue.  However, in the context of a small claims court, you may as well have done so - small claims will historically ALWAYS back the person who set the terms and conditions of a contract, regardless of their legal validity.  We'd have to go to a REAL court to get a judgement in our favor, and a real court and real lawyer are going to cost us FAR more than we'd ever get back, even with punitive damages added in (a quick check shows us unlikely to break even unless we get into the high 6 figures of punitive damages).

So unless Megabus actually does what they said they would in the news broadcasts and reimburses us fully (which I'll believe once I've cashed the check and it's gone through), we're essentially screwed with no recourse.
