Interesting situation

So, my Acura last year about a month after I bought it was involved in a large accident (Sideswiped and the person who hit the vehicle drove off without stopping). Destroyed the entire driver side doors, rims, airbags deployed, not very good. Reported it to my insurance (Geico) and had it taken to a dealership near the accident. Took about a month to appraise it and damages were repaired a month after when I picked the vehicle up and payed the deductible.

Today, trying to trade it in and get my grandmother into a different vehicle (since I am giving it to her, wanted something with better mileage and newer), turns out the vehicle was considered a total loss (according to Carfax). I ask Geico what it was about since the damages were paid for and told me to talk to the dealership (which at the time was off, but whatever), and later the dealership who took care of damages called and stated that it was the insurance co. that dealt with it.

Looking through my documents online, it turns out that Geico indeed considered the car a "total loss", but also paid the dealership for repairs....

To make matters more interesting, the original bank I had it insured under made it impossible to see my current payoff or made it difficult to make a payment (not sure what that was about) and I ended up refinancing the vehicle through another lender, who approved of the refi in the first place.

How do I rectify this situation? Or am I SOL from this entire ordeal?

If it was a judged a total loss, but Geico paid for repairs instead of cutting you a check for the value of the vehicle, then you're supposed to get a Salvage Title to the car.  You own that car.

Get a goddamn lawyer

I am going to try to get this sorted out without the need of an attorney just yet. Hopefully, I can get things done without one. Talking with not only the dealership who sold the car to me, since they were the one who noticed it and talking with the woman who dealt with my claim.

Just don't be surprised if trying to work it out for yourself results in you loosing or forfeiting your rights.

With the repairs done and this being over a year late, I probably already lost the case as is sadly.

No matter what else you do, get everything in writing. Use certified mail with signatures required, etc. If it isn't in writing, it doesn't count or matter. It is also worth rattling chains at the better business bureau (probably won't help much, but the squeaky wheel gets the grease).

Even if you don't plan on getting a lawyer today, you may want to in the future, so document today.

True. I am trying to get all the papers in order to make sure I have everything before I do. My claim information is still accessible on my Geico account and I am just trying to get papers ready for balances and such in case I need them to rectify this.

Honestly?  Read the terms of your agreement with Geico carefully and lawyer up.  This sounds fishy as hell

Got a hold of Geico. They stated that the car was indeed not considered a total loss, hence the repairs after adjustments, but I have to wait until Monday to possibly take care of the Carfax stuff.

Even when you get this resolved. Get everything in writing and keep records in an organized manner. This is the kind of thing that will pop back up in a year or two. Key things you may need to have the records handy for are taxes (this is the kind of financial thing that the IRS tends to bring up 2-3 years later) and when whoever buys the car used sells it again, it will trigger a review of the records. Inevitably, there will be some record still of the car being totalled that will come up and cause questions about fraud and such.

It will be way easier to make detailed and organized records now than to try to reassemble everything in a couple of years.
